The Hearings Examiner holds hearings on the third Monday of every month at 10:00 a.m. in the Planning Annex Hearing Room located at 1002 Dudley Avenue in Prosser, WA. If there are no agenda items, the hearing will be canceled.  Occasionally, due to holidays or other scheduling conflicts, the hearings will be rescheduled.

At its meeting on October 28, 2014, the Board of County Commissioners adopted Resolutions 2014-806 through 2014-829 and Ordinances 536 through 559 replacing the Board of Adjustment with a Hearings Examiner System as the party responsible for making decisions on various permits and appeals. The Hearings Examiner System became effective on January 1, 2015.

agendas, packets, and minutes on our website for dates from December 2009 to December 2015.  If you have any questions regarding past Board of Adjustment actions please contact our office.

The Hearings Examiner shall receive and examine available relevant information, including, but not limited to, environmental documents; conduct public hearings; cause preparation of a record thereof; and adopt findings and conclusions for the following:

(a) Benton County Code (BCC) Title 3 Building and Construction:
(1) Applications for mobile home park permits under Benton County Code, Chapter 3.22; and
(2) Applications for variances from the provisions of Benton County Code, Chapter 3.24; and
(3) Appeals and applications for variance from Benton County Code, Chapter 3.26.  
(b) Benton County Code (BCC) Title 6 Health, Welfare, and Sanitation:
(1) Appeals from determinations of significance under BCC 6.35.115(a), if applicable, from mitigated determinations of non-significance under BCC 6.35.115(b), and of EIS adequacy under BCC 6.35.188(b). 
(c) Benton County Code (BCC) Title 9 Subdivisions:
(1) Appeals of administrative decisions made by the Planning Administrator under Ordinance No. 612, §14.  
(d) Benton County Code (BCC) Title 11 Zoning:
(1) Applications for variances under Ordinance No. 611, §212; and
(2) Applications for conditional use permits under Ordinance No. 611, §213; and
(3) Appeals an of administrative decision made by the Planning Administrator under Ordinance No. 611, §227; 
(4) Decisions regarding multiple detached dwelling permits under Ordinance No. 611, §169; and 
(5) Decisions regarding non-commercial sand and gravel operations under Ordinance No. 611, §170.  

(e) Benton County Code (BCC) Title 15 Environment:
 (1) Decisions regarding requests for critical area review exemptions under Ordinance No. 609, §14; and(2) Decisions regarding public agency and utility exceptions under Ordinance No. 609, §15; and (3) Decisions regarding reasonable use exceptions under Ordinance No. 609, §16; and(4) Appeals of administrative decisions to approve, condition or deny a development proposal under Ordinance No. 609, §27; and(5) Appeals of administrative decisions under Ordinance No. 610, §5.
