Permitted Activities & Allowable Uses of Benton County Property

The following policies have been adopted by the Benton County Board of Commissioners, per Resolution 09-462, in the matter of limiting the use of County property for its intended purpose, effective July 6, 2009.
  1. Unless otherwise restricted by law, First Amendment activities are permitted on the exterior of County facilities, provided that said activities ensure appropriate public access is maintained for fire and safety reasons and that no walkway, driveway, or passageway to a building entrance or parking lot is obstructed. No activities shall be permitted closer than 25 feet from any entrances to County buildings.
  2. Section 1 does not reflect an intent by the County to create a designated public forum.
  3. Interior portions of the building are to be used for official County business only.
  4. The following activities are prohibited in and around all County facilities:
    • Disorderly conduct; 
    • Loud and unusual noises;
    • Activities which impede entrance or exit from the building;
    • Activities which impede or threaten County employees in the performance of duties;
    • Activities which impede or threaten members of the general public in transacting business or obtaining services.
  5. The following activities are prohibited within the lobbies or other interior areas of County facilities, but are permitted on the exterior of County facilities, per Section 1:
    • Campaigning for election to any public office;
    • Displaying or distributing commercial advertising;
    • Collecting signatures on petitions, polls or surveys;
    • Leafleting, distributing literature, picketing, and demonstrating by members of the public;
    • Public assembly and public address, unless conducted or sponsored by the County;
    • Soliciting alms and contributions, except when conducted or sponsored by the County;
    • Depositing or posting handbills, flyers, pamphlets, signs, posters, placards, or other literature except official County and other governmental notices and announcements on the floors, walls, stairs, racks, counters, desks, writing tables, window ledges, or furnishings within interior public areas.
