CUP 2007-007 -- BURKHART -- NULL & VOID



Public Hearing on Conditional Use Permit (CUP 2017-007): The applicants are proposing to operate a daytime dog play center and overnight kennel (by appointment only) on 2.5 acres in RL-5 zone.  The date of the written determination of completeness on this action is September 8, 2017.  The site is located at 3505 N. Goose Gap PR NE Benton City in Section 31, Township 09 North, Range 28 East, W.M. Applicants: Ed & Kaye McClellan

Public Hearing on Conditional Use Permit (CUP 2017-008/EA 2017-015) – The applicants are proposing to operate concrete and asphalt batch plants, stockpile crushed and washed aggregates and crush/process recycled concrete and asphalt.  The date of the written determination of completeness on this action is September 25, 2017.  The site is located on four parcels lying West of Piert Road, intersected by East Cochran Road in Section 23, Township 8 North, Range 30, W.M.  Applicant:  Pronghorn, LLC.

NOTICE IS HEREBY GIVEN that public comment will be taken on the draft work products and amendments to Benton County’s Comprehensive Plan and development regulations at a public hearing Tuesday, November 21, 2017, at 6:00 p.m., in the Benton County Planning Annex Hearing Room at 1002 Dudley Avenue in Prosser.  The Planning Commission will consider all comments received and make their recommendation to the Board of County Commissioners (BOCC).  The BOCC will then conduct a hearing to consider and act upon the Planning Commission’s recommendation.

a.     Ordinance Amendment OA 2017-002 - Zoning regulation amendments to Benton County Code Title 11 as part of the County’s 2017 Periodic Update.  The zoning regulations currently consist of twenty-one (21) ordinances and the proposal is to have one (1) ordinance consisting of twenty-eight (28) chapters, with the creation of new chapters such as the Red Mountain Agricultural District, Conditional Use/Variances, Amendments and Appeals, Non-Conforming Uses and Home Occupation permitting.  This item has been put on hold and will be heard at a later date.

b.     Ordinance Amendment OA 2017-003 - Subdivision regulation amendments to Benton County Code Title 9.   The subdivision regulations are currently divided into four (4) ordinances. To streamline the regulations, Staff is proposing one (1) ordinance with consistent provisions and definitions and including new chapters such as an Introduction (including Definitions), Preliminary Plat, Final Plat, Design and Improvement, Lot Consolidation, and Tax Parcel Separation.  This item has been put on hold and will be heard at a later date.

c.     2017 Periodic Draft Comprehensive Plan UpdateThe Growth Management Act (RCW 36.70A.130) requires that the County have mandatory "periodic updates" of its comprehensive plan and development regulations every eight years to ensure that they comply with the GMA.  Benton County has conducted a full review of the existing Plan and has eliminated outdated information, streamlined and shortened the plan and updated it to ensure consistency with RCW, WAC, BCC, and other codes and requirements.

d.     Ordinance Amendment OA 2017-008 relating to zoning, amending the Official Zoning Map of Benton County to reflect changes in the zoning designation for File No. ZC 2016-001 and for annexation of property into the City Limits of Richland, Kennewick, West Richland and Prosser.  This item has been put on hold and will be heard at a later date.

NOTICE IS HEREBY GIVEN that there has been proposed to the Benton County Planning Department, an application (File No. EA 2017-020/CF 2017-001) received on November 8, 2017 for construction of a 65’ monopole communications tower within a 44 x 49’ fenced compound by: Faulk & Foster for USCOC of Richland.  The date of the written determination of completeness on this action is November 14, 2017. The site is located at 2808 West Sunrise PR NW in Benton City and is legally described as North of Acord Road and West of Horn Road in Section 25, Township 10 North, Range 26 East, W.M.

NOTICE IS FURTHER GIVEN that the Benton County Planning Department will review said application and a public hearing may be scheduled at a later date.  If a public hearing is scheduled, property owners within 300 feet of the boundaries of the project site will receive a public hearing notice. 

NOTICE IS GIVEN that said proposal will be reviewed under the requirements of the State Environmental Policy Act.  The Benton County Planning Department expects to issue a Determination of Non-Significance (DNS) utilizing the optional DNS process set forth in WAC 197-11-355. A copy of the subsequent threshold determination for this proposal may be obtained from the Benton County Planning Department.

NOTICE IS GIVEN that all concerned persons will have fourteen (14) days from the date of publication of this notice to comment in writing on this action.  This comment period may be the only opportunity to comment on the environmental impacts of this proposal. Comments should be submitted to the Benton County Planning Department, P.O. Box 910, Prosser, WA 99350.  Any information submitted to Benton County is subject to the public records disclosure law for the State of Washington (RCW Chapter 42.17) and all other applicable law that may require the release of the documents to the public.
